Participation in Silver Star Raffle
costs £10 per raffle ticket.

There are no restrictions to the number
of entries one person can make.

Monies raised by the Silver Star Raffle
will go to the Silver Star to provide diabetes
awareness.

Payment for participation in the Raffle
can be made by credit of debit card.
-
Your Raffle tickets will be entered into
the draw as soon as the whole payment is received.
-
The promoter accepts no responsibility
if chosen method of payment is cancelled in error.
-
No responsibility is taken for Raffle
tickets lost, delayed, or damaged in the post.
-
Closing date for the receipt of raffle
ticket payment is 31st August 2010. Tickets paid after this
date may not be entered in the draw.

The Silver Star Raffle draw will take
place on September 2010 and would be notified in the website
www.silverstaruk.org and "The Globe".
-
The result of the Raffle draw is final.
No correspondence will be entered into.

The Silver Star Raffle is open to
individuals over the age of 18.
-
Only individuals can participate in the
raffle.
-
The winner will win the right to use a
villa in Eshta Crown Residences located near Kochi,
India subjected to terms and conditions set out in
annexure A.

The winner will be drawn by an
independent person. The promoter's decision is final and
no correspondence will be entered into.
-
Winners will be notified by post within
20 working days of the draw to the name and address of
the registered owners of the winning raffle tickets.

In the event that we cannot contact the
winner within 28 days after the draw, the prize will be
awarded to a new winner.

A list of winners will appear on the
Silver Star website at
www.silverstaruk.org, full address details will not
be disclosed.

If the writing is illegible on the
ticket and no contact details are given, a new winner
will be selected on the day of the draw.

The prizes are non-transferable.

By entering the draw, winners confirm
their agreement to take part in any associated
publicity.

Silver Star respects, and is committed
to protecting your privacy. The personal information you
provide will remain priveate and will only be used for
the purposes outlined here.

Silver Star reserves the right to amend,
withdraw or terminate the raffle of alter the raffle at
any time without prior notice.

Silver Star Raffle is registered by the
Leicester City Council for the purpose of section 5 of
the Lotteries and Amusements Act 1976. No. 4339.

understood like an agreement of this Terms and

Annexure A
Terms & conditions of Silver Star Villa ("SSV")
-
Eligibility criteria to purchase the
Coupons:
(i) In case of individuals (unmarried, married, divorced,
widow, widower or re-married) -
(a) Individuals must not be of unsound mind;
(b) Individuals must be aged 18 years or above.
(ii) In case of companies or associations other than
individuals -
The Coupon purchased by companies or associations must
specify a particular representative of such entity. Further,
such
representative must fulfill the eligibility criteria of
individuals (as set out in Clause 1 (i) above), as if such
applicant were an
individual.
(iii) For the purpose of transfer of the Right to Use the
SSV, as set out in Clause 3 herein, in favour of the Spouse
(as defined
herein), the Spouse must fulfill the eligibility criteria of
individuals (as set out in Clause 1 (i) above). Further,
Spouse shall mean
the following:
At the time of announcement of the Raffle Winner -
(a) The legally married husband of the Raffle Winner;
(b) The legally married wife of the Raffle Winner;
(c) The legally re-married husband of the Raffle Winner;
(d) The legally re-married wife of the Raffle Winner, in
case the Raffle Winner was a divorced man;
(e) In case the Raffle Winner is a man having more than one
wife, all existing and surviving at the same time, (subject
to the
law of the land that the Raffle Winner is governed by), such
wife, as the Raffle Winner may in its sole discretion
declare.
The above Spouse shall be referred to as "Succeeding Spouse
1".
At any time after announcement of the Raffle Winner and
during the subsistence of the Term of Stay -
(a) Upon death or divorce of the Succeeding Spouse 1, the
legally re-married wife or husband (as the case may be) of
hte
Raffle Winner during the life time of the Raffle Winner;
(b) Upon death or divorce of the Succeeding Spouse 1, next
surviving wife of the Raffle Winner, in case the Raffle
Winner is a
man having more than one wife, all existing and surviving at
the same time, subject to the law of the land that the
Raffle
Winner is governed by.
The above Spouse shall; be referred to as "Succeeding Spouse
2". The Succeeding Spouse 1 and Succeeding Spouse 2 shall
collectively be referred to as Spouse.
2.
Transferability:
The Raffle Winner is not
entitled to transfer the Right to Use (as defined below) in
the SSV in favour of any person except the
Nominee (as defined herein) to
be nominated in terms of Clause 5 herein, and such Right to
Use is not redeemable for cash or
exchange.
3.
Life time free stay:
(i) The Raffle Winner would be entitled to a mere Right to
Use (as defined below) the SSV during his/her lifetime
including the life
of the Spouse (the "Term of Stay"). The Term of Stay shall
commence upon the declaration of the Raffle Winner, from any
day in 2014, when the development of the villa is completed
by Eshta, and shall expire, upon demise of the Raffle Winner
and
the Spouse, whichever is later. Upon demise of the Raffle
Winner, the Spouse (either Succeeding Spouse 1 or Succeeding
Spouse 2, as the case may be), as nominated by the Raffle
Winner ("Nominee"), pursuant to exercise of its Right of
Nomination or Nominee Alteration Right shall enjoy the Right
to Use the SSV. In this regard, the Nominee shall be
declared by
the Raffle Winner to Eshta to be registered in its records
("Right of Nomination") in the manner as set out in Clause 5
herein.
(ii) Upon demise of the Raffle Winner and the Nominee, the
Term of Stay shall expire and the Right to Use shall vest
back to
Eshta. The Right to Use, upon such expiry, shall under no
circumstances be transferable to or vest in favour of (i)
any other
spouse of the expired Raffle Winner, (ii) the re-married
spouse of the Nominee upon demise of the Nominee; or (iii)
any other
person.
4. Right to
Use:
Eshta shall offer the Right to
Use (as defined hereunder) the SSV to the Raffle Winner in
accordance with the terms hereunder:
(a) The right to vacant and peaceful use of the SSV;
(b) The right to enjoy all facilities provided by Eshta;
(c) The right to appoint or nominate any direct blood
relative to merely stay at the SSV on behalf of the Raffle
Winner during
his/her lifetime and notified to Eshta.
The above rights shall
however, exclude any of the following rights:
(a) The right, title or ownership of the SSV;
(b) The right to sell, mortgage, charge, dispose of for
consideration, or create any encumbrance in respect of the
SSV;
(c) The right to transfer any of the aforesaid rights to
legal heirs in the event of death by succession or
otherwise.
It is expressly clarified
that the aforesaid rights conferred on the Raffle Winner
merely constitute a right to use and enjoy the
facilities provided by
Eshta and as such, does not constitute a conferral of
ownership, lease, rent or creation of landlord or tenant
relation in relation to
the SSV.
All of the aforesaid
rights and exclusions relating to the SSV shall be
collectively referred to as "Right to Use".
5. Nomination
Process:
(i) At the time of announcement of the winner, the Raffle
Winner shall be required to register the Nominee with Eshta
by
appointing and entering the name of the Succeeding Spouse 1
in a form prescribed by Eshta, along with valid legal
documents
evidencing marriage of the Raffle Winner with the Nominee.
(ii) The Raffle Winner may, at any time during his/her life
time, make a request to Eshta for change of the Nominee, in
the
records of Eshta from Succeeding Spouse 1 to Succeeding
Spouse 2 ("Nominee Alteration Right"). The Nominee
Alteration
Right may be exercised only once, by the Raffle Winner
during his/her life time, only in the following
circumstances:
In the event the Raffle Winner has (a) re-married due to
death of Succeeding Spouse 1, or (b) re-married due to
divorce of
the Succeeding Spouse 1, or (c) decided to change the
Nominee as per his own discretion during his life time,
where such
Raffle Winner is a man having more than one wives, all
existing and surviving at the same time, (subject to the law
of the
land that the Raffle Winner is governed by).
(iii) The Nominee Alteration Right shall vest only with the
Raffle Winner during his/her life time, and shall further be
subject to
the sole discretion of Eshta. Further, the Nominee
Alteration Right may be accepted by Eshta only once, during
the life time
of the Raffle Winner.
(iv) In the event the Raffle Winner is unmarried, he/she
shall have the Right of Nomination and Nominee Alteration
Right after
his/her marriage upon production of valid legal documents
evidencing marriage of the Raffle Winner with the proposed
Nominee.
6. SSV
specification:
(a) This villa would be titled Silver Star villa or SSV;
(b) The approximate size of SSV shall be 850 sq.ft.;
(c) SSV is constructed on about 2,700 to 3,500 sq.ft. of
land;
(d) SSV shall comprise of 1 bed room, living room, dining
room, kitchen, and toilet;
(e) SSV's interiors and furnishing would be done to suite
the standards of the brand and the project;
(f) The cost of the SSV is estimated to be approximately USD
150000.00 (United States Dollars One Hundred and Fifty
Thousand Only);
(g) SSV to be a part of the total development of
approximately 150 villas in about 30 acres of land at
Kakkathuruthu island,
near Cochin.
7.
Other Terms of usage of SSV:
(a) The Right to Use the SSV shall not be provided to
companies or associations, as a guest house for employees.
Only
individuals representing companies or associations at the
time of purchase of Coupons, shall be eligible to
participate and
win;
(b) The Right to Use shall terminate only upon demise of the
Raffle Winner and the Nominee;
(c) Upon termination of the Right to use as mentioned above,
all rights, title and interest in the SSV shall vest
forthwith, in
favour of Eshta and SS UK shall not have nor claim any
rights whatsoever, in SSV;
(d) SSV shall be for the sole use of the Raffle Winner and
the Raffle Winner shall not have any right to enter into any
sublease
with any person;
(e) The Raffle Winner shall not be entitled to enforce or
exercise the Right to Use the SSV in any manner, before the
completion
of the SSV in 2014.
(f) The Raffle Winner (together with family members) shall
ensure that he/she has adequate travel insurance in force
and
effect, during the stay at SSV, and Eshta shall not be
responsible for any injury, illness or death during such
stay of the
Raffle Winner (together with family members) at the SSV;
(g) The Raffle Winner will be responsible for all damages,
breakages or any other changes, modifications or
alternations
(whether structural or otherwise), in respect of the SSV,
which would gave the effect of diminishing or reducing, in
any
manner, the market value of the SSV, during his/her stay at
the SSV;
(h) In exercising the Right to Use the SSV, at any given
point in time, the Raffle Winner shall be entitled to
accommodate a
maximum number of not more than 4 (four) persons who can
stay at the SSV. In case the Raffle Winner is desirous of
accommodating more persons that as mentioned above in the
SSV, he/she shall obtain prior consent of Eshta in writing
in
this regard, upon making an application stating full details
thereof.
(i) Eshta shall keep one duplicate key of the SSV. The
Raffle Winner shall not change any locks of the SSV.
8. Taxes and
maintenance charges of SSV:
(a) Only (direct/indirect) taxes related to the SSV payable
to the government, shall be paid by Eshta;
(b) All charges relating to the Society / owner's
association shall be borne by the Raffle Winner during the
subsistence of the
Right to Use.
(c) All charges related to the Right to Use of SSV (e.g.
electricity, water, telephone, internet) shall be borne by
the Raffle
Winner at actuals.
(d) All charges related to room services, butler services,
and house keeping shall be borne by the Raffle Winner.
(e) Al expenses or charges related to change of furnishing,
furniture, upholstery, linens, cutlery, crockery, etc. shall
be borne
by the Raffle Winner. However, prior approval shall be
obtained by the Raffle Winner from Eshta in respect of any
such
desires changes.
